General Terms and Conditions (GTC)

These terms govern the use of the FM Connect platform (the "Platform"), operated by FM Connect, Bühlstrasse 3a, 8172 Niederhasli, Schweiz (the "Operator"). By registering or using the Platform, users (clients and providers) accept these terms.

FM Connect is an online marketplace connecting clients and providers in facility management. The Operator only provides the technical infrastructure. Service contracts are concluded exclusively between client and provider – the Operator is not a contracting party.

• Registration is open to legal entities and natural persons with legal capacity.
• Information must be truthful and kept up to date.
• Provider accounts are activated after manual review by the Operator.
• Login credentials are confidential; misuse must be reported immediately.

• Providers warrant that they hold all permits and qualifications required for their activities.
• Profiles, prices, availability and certificates must be accurate.
• Requests must be answered within a reasonable period.
• Prohibited content (unlawful, misleading, offensive) is not permitted.

• Requests must be genuine and contain accurate information.
• Agreed appointments and services are binding.
• Communication and payment take place directly with the provider.

Use of the Platform is free of charge for clients.

Two subscriptions are available for providers: Basic (CHF 49.– per month, up to 10 requests per month) and Professional (CHF 149.– per month, unlimited requests). All prices are in Swiss francs plus any applicable statutory taxes.

Introductory offer: until 30 June 2027 both subscriptions are free of charge (CHF 0.–). Regular prices apply thereafter. The Operator will notify providers by email before charging begins.

Subscriptions run monthly and may be cancelled with effect from the end of the current billing period. Amounts already paid are not refunded.

Price changes are announced at least 30 days in advance. Providers may cancel their subscription with effect from the date the new price takes effect.

Prices for the actual facility management services are agreed directly between client and provider. The Operator charges no commission on them.

The Operator is not liable for the quality, timeliness or defect-free performance of services rendered by providers. Liability for damage arising from use of the Platform is limited – as far as legally permissible – to intent and gross negligence. The Operator does not warrant uninterrupted availability of the Platform.

Users grant the Operator the right to display uploaded content (profile texts, logos, descriptions) in the course of operating the Platform. Users warrant that they hold the necessary rights to such content.

Users may delete their account at any time. The Operator may suspend or delete accounts with immediate effect in the event of breaches of these terms, of statutory provisions, or of abusive use.

Personal data is processed in accordance with our privacy policy.

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is – as far as legally permissible – the Operator's registered office in Niederhasli (ZH), Switzerland.

The Operator reserves the right to amend these terms at any time. Users will be informed of material changes by email or via the Platform. Continued use constitutes acceptance of the amended terms.

These terms are provided in several languages. In the event of discrepancies between versions, the German version prevails.
